    Putting Iranian President Ahmadinejad on trial in the Hague (in absentia if necessary) for incitement to commit genocide would be a preventive measure that might deter murderous dictators and perhaps a catastrophic nuclear confrontation. Had the League of Nations been able to charge Hitler with incitement to commit genocide following the publication of “Mein Kampf” the suffering of WWII and the Holocaust might have been averted.



    The shrill voices from Iran, filled with aggression, hate, and threats of a second Holocaust are mixed with European voices of appeasement. They have created an atmosphere reminiscent of the 1930’s, when Nazi aggression, hate, and threats of genocide were met with British and French appeasement. Government leaders failed to protest the inhumane treatment of Jews before the war, much less during the war itself.



    The League of Nations, and its member states did nothing to prevent the abuses of the Fascist regimes in Europe, and even less about the persecution of the Jews in the 1930’s. The absence of opposition to Hitler’s aggression encouraged him to increase the persecution of Jews, intimidate the smaller nations, and ultimately launch an aggressive war and perpetrate genocide on European Jews, known as the Holocaust.



    Mahmoud Ahmadinejad’s efforts to become the most powerful leader of the Islamic world and his personal ambition to bring victory to a triumphant Islam against the infidel West, resembles another maniacal dictator from the 1930’s. Ahmadinejad’s hatred of Jews and Judaism empowers him to deny the Holocaust and strive to wipe out the Jewish State. That is only a prelude to his ultimate goal of dealing with the Christians and Christianity.



    History may not repeat itself in an exact form, but the lesions drawn from history are indisputable. The sooner free nations confront the hate and aggression of fascist regimes, the more lives, resources and freedom will be preserved. British Prime Minister Neville Chamberlain’s appeasement of Hitler cost humanity 60 million lives.



    It is unfortunate that to date, the Free World and the UN have failed to block Iran’s race to arm itself with nuclear weapons. Moreover, today’s appeasers in the West have dismissed the genocidal threats of the Iranian president to bring about “The End of Israel.” Democratic societies have historically failed to grasp the nature of totalitarian regimes and recognize that they operate according to different moral codes. Rather than engage in the minutia of parsing Ahmadinejad words, like those spoken at last October’s anti-Zionism Conference in Teheran, leaders such as Javier Solana of the EU and Kofi Annan, Secretary General of the U.N., should consider the long-range intentions of the Iranian president. Instead, they have groveled at Ahmadinejad’s feet, and paid homage to him. Neither has shown the courage to stand up to him and denounce his Jew-hatred.





    The Free World would do well to deal with a leader whose quest for nuclear weapons and whose threats to “Wipe out Israel” are directly tied to his radical religious beliefs. These genocidal expressions follow similar threats made by Ayatollah Khomeini and former Iranian President Rafsanjani (“We need only one nuclear bomb to wipe out Israel.”). In an interview with Iranian TV El Alam last December, Ahmadinejad declared: “ Israel’s existence is the central obstacle that faces the Islamic nation. “ Symbolically, the words “Tel Aviv and Jerusalem” were written on the Shihab missiles paraded in Teheran.



    The United Nations Convention on the Prevention and Punishment of the Crime of Genocide, 78 U.N.T.S. 277, entered into force on January 12, 1951 states in Article 3: “ The following shall be punishable: “ a) Genocide; b) Conspiracy to commit genocide;

    c) Direct and public incitement to commit genocide; d) Attempt to commit Genocide;

    e) Complicity in Genocide.” Suffice it to say that the Convention on Genocide was a direct result of the Holocaust.



    Article 4 of the U.N. Convention stipulates: “Persons committing genocide or any of the other acts enumerated in Article 3 shall be punished, whether they are constitutionally responsible rulers, public officials or private individuals.” In accordance with the provisions of the above Convention, the International High Court of Justice in Hague indicted a number of individual Rwandans with “incitement to commit genocide.”



    According to the provisions of the Convention, and the fact that a precedent was set in the case of the Rwandan genocide, Ahmadinejad’s declarations that Israel “should be wiped off the map” and his incitement of students to scream "death to the Jews," at a government-sponsored conference called the “World without Zionism” (Oct 26 2005) are not only openly stated declarations of aggressive intent in violation of Art. 2 (4) of the UN Charter, but direct and public incitements to commit genocide, in violation of the Genocide Convention and the Rome Statute of the International Criminal Court, Articles 6 and 25 (3)(e). President Ahmadinejad's attempted “clarification” that he merely advocates the "transfer" of Jews in Israel to German and Austrian provinces, is itself advocacy of forced deportation, another crime against humanity, and is contradicted by his own actions and long-term Iranian policy.



    The combination of religious fanaticism and incitement to commit genocide, coupled with nuclear weapons, makes Iran’s Ahmadinejad the single most dangerous threat to world peace we face today. Putting Ahmedinejad on trial would set a legal precedent, would serve as the public’s conscience against those who incite genocide, and hopefully deter such hate-mongering in the future.
